Copyright and Restrictions

The copyright law of the United States (Title 17, United States Code) governs the making of photocopies or other reproductions of copyrighted materials. The various state privacy acts govern the use of materials that document private individuals, groups, and corporations.

Under certain conditions specified in the law, libraries and archives are authorized to furnish a reproduction if the document does not infringe the privacy rights of an individual, group, or corporation. These specified conditions of authorized use include:

History

Independence National Historical Park (INDE) was authorized by an act of Congress on June 28, 1948, and was formally established on July 4, 1956, “preserving for the benefit of the American people as a national historical park certain historical structures and properties of outstanding and national significance…associated with the American Revolution and the founding and growth of the United States.” Located in the Society Hill, Old City, and Germantown neighborhoods of Philadelphia, Independence National Historical Park encompasses not only such famous sites and artifacts as Independence Hall, Congress Hall, and the Liberty Bell, but over twenty other structures, gardens, squares, and cemeteries. These include the reconstructed Graff House (site where Thomas Jefferson drafted the Declaration of Independence), Franklin Court (site of Benjamin Franklin’s house), Carpenters’ Hall (meeting place of the First Continental Congress), and the Deshler-Morris House (where George Washington lived for brief periods in 1793 and 1794).

On August 9, 1946, Congress enacted Public Law 711 that created the Philadelphia National Shrines Commission. The Commission was charged by Congress to develop a plan to preserve significant buildings in Philadelphia as part of a park to be administered as a unit of the National Park Service. The Commission submitted its report to Congress in 1947 and outlined an ambitious plan of property acquisition. The Commission’s report included draft legislation that would form the basis of INDE’s 1948 enabling legislation.

Enabling legislation provides authorization and direction to the National Park Service to acquire the lands to create a federal park. The initial focus for the establishment of INDE was to develop agreements with the City of Philadelphia and the Carpenters’ Company to transfer the preservation and maintenance of the Independence Square buildings and Carpenters’ Hall to the National Park Service. Both the City of Philadelphia and the Carpenters’ Company maintain ownership of these buildings. The enabling legislation also authorized the Secretary of the Interior to acquire lands by donation, purchase, or condemnation and made the creation of the park contingent on securing titles to the First United States Bank property, the Merchants’ Exchange property, the Bishop White house, the Dilworth-Todd-Moylan house, and the site of the Benjamin Franklin house, together with two-thirds of the remaining lands describing in the property acquisition plan outlined by the Shrines Commission. The Commission conceived of the areas of the new park as “Projects” that were identified with letter designations. Project A encompassed the three full city blocks extending east from Independence Square and bounded by Chestnut, Walnut, 2nd, and 5th Streets. Project B consisted of a thoroughfare extending south of Walnut Street to the north side of Manning Street and between 4th and 5th Streets. Project C contained the land comprising Franklin Court, and Project E contained the land immediately adjacent to Christ Church on the corner of 2nd and Market Streets.

In 1949, Congress appropriated $500,000 for use in the first year of the project. With funding secured, the National Park Service opened a Philadelphia office in October 1949. The office consisted of a small staff whose goal was to acquire the proposed lands needed to establish INDE. In early 1950, the National Park Service contracted with the Land Title Bank and Trust Company and the Commonwealth Title Company of Philadelphia to conduct title searches on 123 properties. Having gathered the requisite information from the title searches, the National Park Service hired contractors to conduct appraisals and prepare declarations of taking for properties within the park’s Project sites. In 1950, the National Park Service also secured the necessary agreements with the City of Philadelphia and the Carpenters’ Company.

INDE received increased federal funding throughout the 1950s which was used in part to secure titles for additional properties. Having met the requirements outlined in the enabling legislation, Independence National Historical Park was formally established in 1956. Additional land transactions occurred in the decades that followed, though never on the scale of those from the 1950s. After INDE was established, the park was enlarged to include Independence Mall, Washington Square, and Area F—the block bounded by Chestnut, Walnut, Front, and 2nd Streets. INDE also administers other National Park Service sites in Philadelphia. These unit sites have their own enabling legislation and include the Edgar Allan Poe National Historic Site (EDAL), the Thaddeus Kosciuszko National Memorial (THKO), and Gloria Dei Church (GLDE).

Description:
The Lands and Deeds Records document the early process by which the Department of the Interior acquired lands to establish Independence National Historical Park (INDE). Documents relate to the appraisal and acquisition of individual land tracts, and also contain information about project areas as a whole. The records are mainly textual in nature and contain both original and photocopied legal documents, including declaration of taking files, land ownership records, leases, insurance policies, indentures, and land titles. Additional materials include maps, photographs, deeds, correspondence, agreements, and memorandums.

The records date primarily from the early 1950s when the National Park Service completed most of the land transactions for INDE. More recent documents in the collection reflect boundary adjustments within the park. The Lands and Deeds records document land acquisitions by the U.S. federal government. Additional information on these buildings and lands can be found in other Resource Management records available in the INDE Library and Archives. In the 1970s, the National Park Service assigned INDE new land tract numbers. As a result, both the old and new numbers are used interchangeably throughout the collection. A crossover document noting these changes is included in Series II. Reference Files.

This series contains documents pertaining to the acquisition of individual land tracts encompassing Independence National Historical Park, as well as related NPS unit sites such as the Edgar Allan Poe National Historic Site (EDAL), Thaddeus Kosciuszko National Memorial (THKO), and the Gloria Dei Church National Historic Site (GLDE). Unless otherwise noted, all files refer to INDE. General files for Project B, Project C, and Project E are included near the end of the series. The records include land descriptions, financial appraisals, floor plans, assessments of specific neighborhoods, and photographs of buildings that once stood on INDE property. Specific materials include correspondence, maps, agreements, memorandums, deeds, and leases.

This series includes materials related to the Lands and Deeds Records as a whole, as well as reference documents to assist users in navigating the Land Tract Files in Series I. There is a master deed listing, a record of primary location codes, and a crossover document containing original tract numbers along with the newly assigned ones. The series also contains Land Ownership Records, which contain brief overviews of each tract, and include legal descriptions, methods of acquisition, costs, and physical characteristics of each property. "Declaration of Taking" files relate to the condemnation proceedings that led to the U.S. government acquiring some park lands by eminent domain.
