Description of Park-Specific Terms and Conditions

Park-specific conditions for Voyageurs' Commercial Use Authorizations (CUAs) are established to protect visitors and provide for their enjoyment of the resource, as well as to protect the resources and values of Voyageurs National Park and the purposes for which it was established.

The conditions below are specific to Voyageurs. While they do not include the standard language applied to all CUAs issued nationwide, some of them are also written to clarify and provide additional details to the nationwide CUA conditions. To view the standard terms and conditions that apply to all CUAs nationwide, CUA holders should consult their current valid CUA or visit the National Park Service's CUA website.

Note on towing: all activities with a motorized boat allow for "incidental towing" of disabled vessels. A similar provision applies to snowmobile tours for disabled snowmobiles in winter.

 

Recent Changes

  1. Boat Rental Section: the requirement to include marine band radios in every rental craft was struck (06/30/2024). This decision was based on feedback from CUA holders and established US Coast Guard regulations for recreational vessels. Marine band radios are still highly recommended, but not required for recreational rental craft.
  2. Boat Tours - Non-motorized section: group size limits increased up to 18 paying customers and 3 guides, with a guide to client ratio of no more than 6 clients per 1 guide (06/30/2024). This decision was based on feedback from camping guides and campsite occupancy limits.

Boat Tours - Motorized

Includes:
  • Guided fishing (summer and winter)
  • Water taxi services

  1. Definition of Services Authorized Under This Permit:
    1. Guided Fishing
      1. Pickup, drop-off, and transport of persons and fishing equipment via vessel for the purpose of locating and catching fish.
        1. During periods when lake surfaces are frozen Holders may supply guided fishing services upon frozen lake surfaces within conditions established herein.
      2. Supplying fishing equipment for use to include rods, reels, line, lures, nets, fish finders, bait, or other legal fishing equipment.
      3. Transport of live or dead fish in a manner and quantity allowed by state law.
      4. Supplying gas for vessels associated with fishing activities.
      5. Assisting clients with food preparation.
      6. Incidental towing of disabled vessels encountered, provided it does not significantly interfere with the purpose of the trip.
    2. Water Taxi
      1. Pickup, drop-off, and transport of persons and recreational or camping equipment at arranged locations, dates, and times.
      2. Assistance in loading, unloading, overland transport, or setup of recreational or camping equipment that was transported by Holder of this authorization.
      3. Supplying gas for vessels used for the activity.
      4. Incidental towing of disabled vessels encountered, provided it does not significantly interfere with the purpose of the trip.
    3. Tours Motorized
      1. Pickup, drop-off, and transport of persons via motorized vessel for the purpose of sightseeing, viewing wildlife, viewing dark skies, learning about park resources or history, visiting destination sites, or similar general touring activities.
      2. Supplying persons with accurate interpretative information about park resources and history.
      3. Engaging in day hiking activities with clients.
      4. Supplying basic hiking equipment such as poles, backpacks, water, or store- bought pre-packaged food for use if hiking will occur.
      5. Supplying gas for vessels used for the activity.
      6. Incidental towing of disabled vessels encountered, provided it does not significantly interfere with the purpose of the trip.
  1. Prohibited Activities:
    1. Violating any state or federal law related to fish and wildlife.
    2. Knowingly allowing or encouraging any client, customer, or visitor to violate state or federal fish and wildlife laws.
    3. Violating any laws or regulations related to vessel use, safety, or registration.
    4. Interfering in use and enjoyment of park areas by visitors not utilizing services of the Holder.
    5. Advertising specific pickup times or locations on a set schedule.
    6. Storing vessels or any equipment within Park boundaries other than during an active trip.
    7. Use of any personal watercraft (e.g., jet ski, wave runner) in the course of providing authorized services within park boundaries.
    8. Soliciting business of any kind within park boundaries.
  1. General Safety
    1. The Holder shall have a basic first aid kit sufficient to address first aid level injury or illness aboard the vessel while operating under this authorization.
    2. If any food preparation takes place by the Holder for clients, applicable elements of the FDA Food Code and NPS Reference Manual 83A shall be followed and a food handler certification must be obtained and supplied upon demand.
  1. Water Safety:
    1. Vessels used to provide service shall be in good working order with no defects or damage likely to cause them to become nonoperational or take on water.
    2. Vessels used to provide the authorized service shall have all required safety equipment aboard.
    3. Vessels used must have an operational marine band radio.
    4. The Holder is required to ensure a serviceable, well-fitting personal flotation device is available for each client.
    5. The Holder shall check weather forecasts before departing on trips, and shall not place themselves or clients at undue risk if severe thunderstorms, high waves, or other hazardous weather are forecast during the time of the intended trip.
  1. Hiking Safety:
    1. Holder must maintain a CPR and first aid certification at minimum, and will supply certifications upon demand.
    2. Holder will maintain a basic first aid kit and shall carry it with on all hikes exceeding 0.5 miles from the embarkation point.
    3. Holder will keep at least one form of reliable communication such as a marine radio, cellular phone with reliable service at locations travelled, satellite phone, locator beacon, or other communication device on their person at all times while on a hike.
    4. Holder will check the weather forecast before each hike and will not depart on trips if severe thunderstorms, tornadoes, blizzards, or other extreme weather events are forecast for the travel area.
    5. Guide to client ratio shall not exceed 6 clients to 1 guide during hikes.
  1. Hiking Trail Travel and Use:
    1. While engaged in hiking the Holder will travel upon maintained trails and will not engage in off-trail travel unless unforeseen issues require a deviation from maintained trails. The Holder will continue back onto the maintained trail when safe to do so.
    2. Holder should report any observed trail safety or maintenance issues to the Park at their earliest convenience.
    3. Holder may not split up a larger group into smaller and closely following groups to stay below the 6-client maximum limit during hikes.
      1. Any split of groups must have their own guide and be no closer than 0.5 miles from any associated hiking group.
    4. Causing excessive damage or trail wear to any vegetation, natural, or cultural resources during hikes is prohibited.
    5. Holder will practice good outdoor ethics, including not leaving any garbage or refuse, as well as practicing proper disposal of any human waste.
  1. Aquatic Invasive Species:
    1. The Holder of this authorization shall ensure that all vessels, trailers, or other equipment utilized undergo any required decontamination procedures related to aquatic invasive species. Information on decontamination can be found via MN DNR and Voyageurs National Park websites.
    2. The Holder shall not transport client equipment they believe or know to be contaminated with invasive species, or having been in infested waters, until such equipment has been decontaminated.
  1. Fishing Guide Licensing:
    1. Holders engaged in guided fishing shall possess a valid Minnesota fishing license while conducting guided fishing trips and shall supply the same upon demand to any NPS representative.
    2. Holder shall ensure clients engaged in fishing have a valid Minnesota fishing license in possession.
  1. Winter Fishing Guide
    1. During times when lake surfaces are frozen the Holder may accompany clients to fishing locations via snowmobile or other legal forms of transportation. Any required license to operate the mode of transport shall be in possession and produced upon demand by any National Park Service representative.
    2. Holder may provide a fishing shelter and associated fishing equipment for day use provided they are with clients for the entirety of the day.
    3. The guide to client ratio for guided winter fishing is no more than 6 clients per 1 guide.
  1. Motorboat Capacity:
    1. No more than six (6) persons will be transported in a motorized vessel unless U.S. Coast Guard regulations allow for additional passengers and the vessel in use is rated for the number and weight being transported. No more than twelve (12) persons will be transported in a motorized vessel regardless of U.S. Coast Guard regulations or vessel capacity allowing more.
    2. The combined weight of the Holder, clients, and any associated equipment shall not exceed the vessel capacity at any time while in transit.
  1. Motorboat Pilot: Must be licensed by the U.S. Coast Guard for operation of “Uninspected” boats (“Six Pack License”) at minimum if transporting paying customers via motorized vessel. Issued license must be in possession at all times while operating under approved service and must be produced upon demand by any representative of the National Park Service.
  1. Employee List:
    1. The Holder shall provide a list of any employees operating under this authorization along with any certifications or licenses required or requested by the Government. The employee list shall be updated or confirmed as accurate no less than once per year.
  1. Closures and Public Use Limits: Voyageurs National Park retains the right to close any landing or associated area during emergencies, floods, or other unforeseen situations. In the event the National Park Service closes a National Park Service-controlled area, the Commercial Use Authorization (CUA) holder (Holder) is not permitted to use the closed portion of the controlled area for any reason. No reimbursement for canceled reservations will be provided to the Holder.
  1. Subject to Change: All stipulations and conditions herein are subject to change without written notice, and without compensation to the Holder or liability to the United States. There is no appeal process.
  1. Revocation or Suspension: At the discretion of the Superintendent, the authorization may be canceled or suspended at any time for any length of time without compensation to the Holder or liability to the United States. Any appeal process will be made available to the appropriate party if a CUA is suspended, terminated, etc.
  1. Non-compliance or Nonadherence: Failure to comply with any of the Special Park Conditions of the Commercial Use Authorization per 54 USC sec 101925 may result in the immediate suspension or termination or non-renewal of the Holders’ application by the Superintendent. There is no appeal process to this determination.
  1. Carrying Commercial Use Authorization at All Times: Holder shall ensure that each of their employees receives a copy of the authorization and understands the content, conditions, and stipulations. Additionally, Holder ensures the signed Authorization, or at a minimum, the park specific conditions section, will be carried by the Holder and/or their employees. The National Park Service retains the right for the CUA Program Manager, Superintendent, Law Enforcement Park Rangers, and any other person designated by the CUA Program Manager to request an Authorization check at any time on National Park Service jurisdiction, including during peak use. Holder or employees may carry CUA cards printed by the Park in lieu of the full authorization in order to prove they possess a valid authorization if checked by NPS staff.
  1. Accidents: CUA staff must notify law enforcement staff immediately following any accident (considered reportable by law) or injury (beyond basic first aid) by calling the National Park Service Emergency Dispatch at (440) 546-5945. All accidents, including near misses must be reported on the Annual Report (Form 10-660).
  1. Payment Rendered for Services: Holder and their employees are not permitted to collect any form of payment on National Park Service property for any reason.
  1. Vessel Inspections: Vessels used in providing services under this permit may be inspected by NPS Personnel to evaluate safety and condition.
  1. Annual Report: A complete annual report must be submitted by season end or February 15, whichever comes first, of each year. Failure to provide an Annual Report by established deadlines will be grounds for suspension or denial of future applications.

Boat Tours - non-motorized

Includes:
  • Guided paddle trips

  1. Definition of Services Authorized Under This Permit:
    1. Providing canoes, kayaks, other human propelled craft, or non-power-driven craft and any associated equipment for use.
    2. Providing a guide for the duration of trips.
    3. Providing camping equipment to include tents, sleeping pads, and cooking equipment for multi-day trips.
    4. Providing food for the duration of the trip.
    5. Preparing food if a food handler certification is obtained by Holder.
    6. Supplying persons with accurate interpretative information about park resources and history.
    7. Engaging in day hiking activities with clients.
    8. Supplying basic hiking equipment such as poles, backpacks, water, or store-bought pre- packaged food for use if hiking will occur.
  1. Prohibited Activities:
    1. Violating any state or federal law related to fish and wildlife.
    2. Knowingly allowing or encouraging any client, customer, or visitor to violate state or federal fish and wildlife laws.
    3. Violating any laws or regulations related to vessel use, safety, or registration.
    4. Interfering in use and enjoyment of park areas by visitors not utilizing services of the Holder.
    5. Advertising specific pickup times or locations on a set schedule.
    6. Storing vessels or any equipment within Park boundaries other than during an active trip.

  1. General Safety
    1. Each guide shall be certified in first aid and CPR, or equivalent, at minimum and must supply documentation upon demand by Park representative.
    2. The Holder shall have a basic first aid kit, sufficient to address first aid level injury or illness, in their possession while operating under this authorization.
    3. The Holder shall ensure no less than one method of emergency communication such as a cellular phone, marine band radio, emergency locator beacon, etc.… is available to them and stored in a manner that it will remain dry and operable in case of an emergency.
    4. If any food preparation takes place by the Holder for clients applicable elements of the FDA Food Code and NPS Reference Manual 83A shall be followed and a food handler certification must be obtained and supplied upon demand.
  1. Water Safety:
    1. The Holder shall check weather forecasts before departing on trips and shall not place themselves, or clients, at undue risk if severe thunderstorms, high waves, or other hazardous weather are forecast during the time of the intended trip.
    2. Guides shall have training and knowledge in water rescue techniques.
    3. Guide to client ratio shall not exceed six (6) clients per one (1) guide.
    4. No trip shall exceed eighteen (18) paying customers and three (3) guides.
    5. Guides are required to carry an operational marine band radio with them at all times while upon the water.
  1. Vessel Safety:
    1. Vessels must be in good working order with no visible cracks, holes, or other defects which cause, or are likely to cause, the vessel to take on water.
    2. Vessels used to provide service shall have all required safety equipment aboard.
    3. The Holder is required to ensure a serviceable well-fitting personal flotation device and a bailing device, (except for paddleboards) is available for each client.
  1. Hiking Safety:
    1. Holder will maintain a basic first aid kit and shall carry it with on all hikes exceeding 0.5 miles from the embarkation point.

    1. The Holder shall provide a list of any employees operating under this authorization along with any certifications or licenses required or requested by the Government. The employee list shall be updated or confirmed as accurate no less than once per year.

Boat Rental

Includes:
  • Motorboat rental
  • Non-motorized boat rental
  1. Definition of Services Authorized Under this Permit:

    1. Boat Rental: Non-Motorized

      1. Providing kayaks, canoes, stand up paddleboards, or other non-power-driven vessels and any associated equipment for use.
      2. Drop off of non-motorized vessels at boat launches at pre-arranged dates and times to locations within the park.
      3. Recovery and removal of non-motorized vessels from park lands and waters.
      4. Recovering or towing damaged or unserviceable vessels owned or leased by Holder.

    2. Boat Rental: Motorized
      1. Providing power-driven vessels and associated equipment for use.
        1. Power driven vessels include internal combustion and electric engines.
      2. Towing of damaged or unserviceable vessels owned or leased by Holder.
      3. Basic repair of vessels owned or leased by Holder within park boundaries to include:
        1. Propeller replacement
        2. Battery jump/replacement
        3. Checking and adding engine fluids
        4. Minor repair to drive systems

  2. Prohibited Activities:
    1. Violating any laws or regulations related to vessel use, safety, or registration.
    2. Interfering in use and enjoyment of park areas by visitors not utilizing services of the Holder.
    3. Supplying a guide to take clients to destinations.
    4. Leaving unattended vessels or equipment at any harbor, dock, visitor center, or parking lot for 12 hours or more.
    5. Soliciting business of any kind within Park boundaries.
    6. Conducting repairs within park boundaries exceeding those required to return a vessel to port for more extensive repairs.
    7. Use or rental of any personal watercraft (e.g., jet ski, wave runner) in the course of providing authorized services.

  3. Safety
    1. Holder shall provide a well-fitting and serviceable personal flotation device for each person that will be aboard a vessel.
    2. A bailing device (not required for a paddleboard) shall be provided for each non-motorized vessel.
    3. Vessels must be inspected for damage by the Holder prior to each trip.

  4. Equipment Condition
    1. Vessels must be in good condition with no visible cracks, holes, or other defects which could cause the vessel to take on water or otherwise be deemed unfit for operation.
    2. All vessels shall have any US Coast Guard (USCG) required safety equipment aboard prior to drop off or departure. All such equipment will be in good working order and must be unexpired if an expiration date is indicated.

  5. Registration: All vessels shall have current unexpired registration aboard the vessel and shall have Hull Identification Numbers in accordance with the laws of the state where registered.

  6. Aquatic Invasive Species:
    1. Holder of this authorization shall ensure that all vessels, trailers, or other equipment utilized undergo any required decontamination procedures related to aquatic invasive species.

  7. Vessel Recovery:
    1. Vessels and equipment left by customers of Holder within the park must be recovered as soon as practicable.
    2. No vessels or equipment shall remain unattended in the park for more than 12 hours after drop-off by a customer.
      1. Vessels and equipment being used by customers of the Holder for multi-day trips are exempt from conditions for recovery by holder while being used in conjunction with a valid camping permit at campsites where a reservation is held.
    3. Equipment left unattended upon park lands or waters for 24 hours will be considered abandoned and seized.
    4. NPS staff and volunteers will not take possession of or safeguard vessels or equipment left by customers.
    5. Vessels and equipment may not be stored in visitor centers, launches, shorelines, or government buildings.

  8. Vessel Orientation:
    1. The Holder shall train and orient customers on safe use of the vessel to be utilized.
      1. Training may be in person or via video and shall include at minimum:
        1. Basic vessel operation
        2. Basic paddle strokes (if the vessel is propelled by paddle)
        3. Basics of sailing (if vessel is wind propelled)
        4. Special vessel features and operation
        5. Basics of self-rescue
        6. Basic navigation
        7. The location of all required safety equipment

  9. Safety Briefing:
    1. The Holder shall provide a safety briefing to all customers.
      1. The safety briefing may be in person, over the phone, or via video call and shall include at minimum:
        1. Expected weather conditions for the duration of the trip.
        2. Navigation hazards
        3. Basic water safety information
        4. Any other pertinent safety information

  10. Employee List:
    1. The Holder shall provide a list of any employees operating under this authorization along with any certifications or licenses required or requested by the Government. The employee list shall be updated of confirmed as accurate no less than once per year.

  1. Definition of Services Authorized Under This Permit:
    1. Towing of damaged vessels.
    2. Minor repair and maintenance, within park boundaries, of damaged vessels to include:
      1. Propeller replacement
      2. Battery jump/replacement
      3. Checking and adding engine fluids
      4. Minor repair to drive systems
    3. Recovery of sunken or grounded vessels, vehicles, and equipment
    4. Hauling of equipment and material
  1. Prohibited Activities:
    1. Transport of paying passengers unrelated to salvage or towing operations.
    2. Transport of recreational or camping equipment.
    3. Recovering or repairing vessels, vehicles, or equipment in a manner likely to cause excessive damage to vegetation or other park resources.
    4. Recovering or repairing vessels, vehicles, or equipment in a manner likely to introduce more than one gallon of petroleum product, coolant, or other hazardous material into the environment.
    5. Soliciting business of any kind within Park boundaries.
  1. Safety Equipment:
    1. Vessels used to provide service shall have all required safety equipment aboard.
    2. The Holder is required to ensure a serviceable well-fitting personal flotation device is available for each person aboard their vessel.
    3. Any specialized equipment used to recover sunken or grounded vessels shall be inspected by the Holder for condition prior to use.
  1. Fuel Delivery:
    1. When hauling fuel or transferring fuel, provision must be made for secondary containment to include cloths under the fuel nozzle to prevent any drippage of fuel either onto the ground or into the lake.
    2. Must comply with all state and federal requirements for transportation of gas, diesel, or propane.
  1. Spills:
    1. Holder shall report forthwith to a law enforcement ranger or the Superintendent any spill of a hazardous substance such as gas, propane, diesel, etc…believed to be in excess of one gallon.
    2. Holder shall maintain a spill kit aboard the vessel anytime they are hauling gas, diesel, propane or any other hazardous substance. The kit shall include absorbent booms, socks, or other products designed to absorb hazardous spills in a marine environment. The kit shall be able to absorb no less than 100 gallons of hazardous substances such as gas or diesel fuel.
  1. Employee List: The Holder shall provide a list of any employees operating under this authorization along with any certifications or licenses required or requested by the Government. The employee list shall be updated or confirmed as accurate no less than once per year.
  1. Registration: All vessels shall have current unexpired registration aboard the vessel and shall have Hull Identification Numbers in accordance with the laws of the state where registered.
  1. Closures and Public Use Limits: Voyageurs National Park retains the right to close any landing or associated area during emergencies, floods, or other unforeseen situations. In the event the National Park Service closes a National Park Service-controlled area, the Commercial Use Authorization (CUA) holder (Holder) is not permitted to use the closed portion of the controlled area for any reason. No reimbursement for canceled reservations will be provided to the Holder.
  1. Subject to Change: All stipulations and conditions herein are subject to change without written notice, and without compensation to the Holder or liability to the United States. There is no appeal process.
  1. Revocation or Suspension: At the discretion of the Superintendent, the authorization may be canceled or suspended at any time for any length of time without compensation to the Holder or liability to the United States. Any appeal process will be made available to the appropriate party if a CUA is suspended, terminated, etc.
  1. Non-compliance or Non-adherence: Failure to comply with any of the Special Park Conditions of the Commercial Use Authorization per 54 USC sec 101925 may result in the immediate suspension or termination or non-renewal of the Holders’ application by the Superintendent. There is no appeal process to this determination.
  1. Carrying Commercial Use Authorization at All Times: Holder shall ensure that each of their employees receives a copy of the authorization and understands the content, conditions, and stipulations. Additionally, Holder ensures the signed Authorization, or at a minimum, the park specific conditions section, will be carried by the Holder and/or their employees. The National Park Service retains the right for the CUA Program Manager, Superintendent, Law Enforcement Park Rangers, and any other person designated by the CUA Program Manager to request an Authorization check at any time on National Park Service jurisdiction, including during peak use. Holder or employees may carry CUA cards printed by the Park in lieu of the full authorization in order to prove they possess a valid authorization if checked by NPS staff.
  1. Accidents: CUA staff must notify law enforcement staff immediately following any accident (considered reportable by law) or injury (beyond basic first aid) by calling the National Park Service Emergency Dispatch at (440) 546-5945.   1. Vessel Inspections: Vessels used in providing services under this permit may be inspected by NPS Personnel to evaluate safety and condition.
  1. Annual Report: A complete annual report must be submitted by season end or February 15, whichever comes first, of each year. Failure to provide an Annual Report by established deadlines will be grounds for suspension or denial of future applications.

Houseboat and Camper Support Services

  1. Definition of Services Authorized Unter This Permit:
    1. Towing of damaged or grounded vessels owned or leased by Holder.
    2. Movement of the boat/vessel: piloting and anchoring of boat for customers.
    3. Emergency repairs to hull, propulsion, or steering systems required to return the owned or leased vessel to port.
    4. Repair of operating systems.
    5. Delivery of groceries, beverages (including alcoholic beverages), and ice.
    6. Delivery and replacing propane tanks for cooking grills, appliances, and systems.
    7. Filling freshwater tanks.
    8. Stocking cooking/pantry supplies and utensils, paper products, bedding/linen supplies, and general cleaning materials, first aid supplies, fire extinguishers, and lifesaving equipment.
    9. Replacement of light bulbs in general illumination fixtures located in the cabin or used for deck lighting.
    10. Replacement of minor plug-in appliances.
    11. Provision of fuel for vessels and gas-powered equipment.
    12. Pumping of black and grey water holding tanks.
    13. Garbage removal.
    14. Firewood delivery.
    15. Incidental towing of disabled vessels encountered provided it does not significantly interfere with the purpose of the trip.
  1. Prohibited Activities:
    1. Smoking at any time while fueling.
    2. Leaving the fueling nozzle unattended at any time while fueling.
    3. Any cleaning of the outside of vessels.
    4. Use of any personal watercraft (e.g., Jet Ski, Wave Runner) in the course of providing authorized services.
    5. Soliciting business of any kind within Park boundaries.
  1. Fuel Delivery and Spill Mitigation:
    1. Holder shall maintain a spill kit aboard the vessel anytime they are hauling gas, diesel, propane, or any other hazardous substance. The kit shall include absorbent booms, socks, or other products designed to absorb hazardous spills in a marine environment. The kit shall be able to absorb no less than 5 gallons of hazardous substances such as gas or diesel fuel.
    2. Must comply with all state and federal requirements for transportation of gas, diesel, or propane.
    3. Must report any discharge of vessel fluids believed to be at or more than 5 gallons, per State regulation, to the Park and any appropriate State agency.
  1. Blackwater:
    1. All State and USCG licenses and guidelines related to handling of blackwater/sewage will be maintained and followed. Any incident resulting in discharge of blackwater to the water or lands of the park will be reported to the Chief Ranger as soon as possible following containment of incident, no later than the following day. Additionally, the appropriate State agencies will be notified.
  1. Alcohol Delivery: any employee of the Holder delivering alcohol must be at least 18 years of age, per State regulation.

  2. Boat Pilot / Operator: Must be licensed by the U.S. Coast Guard for operation of “uninspected” boats ("Six Pack License") at minimum if moving a vessel with passengers aboard. Boat operators while not transporting guests must be trained by employer in safe boating practices and must comply with Coast Guard requirements.

  3. Safety:
    1. Vessels used to provide service shall be in good working order and shall have all required safety equipment aboard.
    2. The Holder is required to ensure a serviceable well-fitting personal flotation device is available for each person aboard the vessel.

Non-compliance or Non-adherence: Failure to comply with any of the Special Park Conditions of the Commercial Use Authorization per 54 USC sec 101925 may result in the immediate suspension or termination or non-renewal of the Holders' application by the Superintendent. There is no appeal process to this determination.

  6. Carrying Commercial Use Authorization at All Times: Holder shall ensure that each of their employees receives a copy of the authorization and understands the content, conditions, and stipulations. Additionally, HOlder ensures the signed Authorization, or at a minimum the park specific conditions section, will be carried by the Holder and/or their employees. The National Park Service retains the right for the CUA Program Mangager, Superintendent, Law Enforcement Park Rangers, and any other person designated by the CUA Program Manager to requeist an Authorization check at any time on National Park Service jurisdiction, including during peak use. Holder or employees may carry CUA cards printed by the park in lieu of the full authorization in order to prove they possess a valid authorization if checked by NPS staff.

  7. Accidents: CUA staff must notify law enforcement staff immediately following any accident (considered reportable by law) or injury (beyond basic first aid) by calling the National Park Service Emergency Dispatch at (440) 546-5945. All accidents, including near misses, must be reported on the Annual Report (Form 10-660).

  8. Payment Rendered for Services: Holder and their employees are not permitted to collect any form of payment on National Park Service property for any reason.

  9. Vessel Inspections: Vessels used in providing services under this permit may be inspected by authorized NPS Personnel to examine documents, licenses, or permits relating to operation of the vessel, and to inspect the vessel to determine compliance with regulations pertaining to safety equipment, vessel capacity, marine sanitation devices, and other pollution and noise abatement requirements in accordance with 36 CFR§3.4.

  10. Annual Report: A complete annual report must be submitted by season end or February 15, whichever comes first, of each year. Failure to provide an Annual Report by established deadlines will be grounds for suspension or denial of future applications.

Skiing/Snowshoeing Tours

  1. Definition of Services Authorized Under This Permit:
    1. Providing a guide to escort customers for the duration of a trip.
    2. Supplying skis, snowshoes, and associated equipment for use within park boundaries.
    3. Supplying customers with appropriate winter clothing for the elements.
    4. Providing camping equipment to include tents, sleeping pads, and cooking equipment for multi-day trips.
    5. Providing food for the duration of the trip.
    6. Preparing food if a food handler certification is obtained by Holder.
    7. Supplying persons with accurate interpretative information about park resources and history.
  1. Prohibited Activities:
    1. Interfering in use and enjoyment of park areas by visitors not utilizing services of the Holder.
    2. Engaging in tours when a blizzard warning, winter storm warning, or winter storm watch has been issued in the intended area of travel.
    3. Storing equipment within Park boundaries other than during an active trip.
    4. Advertising specific trip times or locations on a set schedule.
    5. Soliciting business of any kind within Park boundaries.

  1. Equipment Condition:
    1. Holder shall inspect equipment prior to use and will ensure all equipment is in good working order with no visible damage or defects likely to cause it to become inoperable.

  1. Safety:
    1. Holder must maintain a CPR and first aid certification at minimum and will supply certifications upon demand.
    2. Holder will maintain a basic first aid kit and shall carry it with on all trips exceeding 0.5 miles from the embarkation point.
    3. Holder will keep at least one form of reliable communication such as a marine radio, cellular phone with reliable service at locations travelled, satellite phone, locator beacon, or other communication device on their person at all times while on a trip.
    4. Holder will check the weather forecast before each hike and will not depart on trips if severe thunderstorms, tornadoes, blizzards, or other extreme weather events are forecast for the travel area.
    5. The Holder shall provide ice picks to all customers utilizing equipment within park boundaries prior to the establishment of the first snowmobile trail within the park for the season.
    6. Group size limits for winter hiking, skiing, or snowshoeing on groomed or marked trails is 6 clients per 1 guide with a maximum of 12 clients with no lesst than 2 guides.
    7. Holder shall provide a safety briefing to each client, either via video or in person, to include at minimum:
      1. Winter survival in a subzero degree wilderness environment.
      2. Expected weather conditions for the duration of the trip.

  1. Camping:
    1. The holder shall obtain any required permits for camping within the park and may not exceed established site capacity limits. No preference for camping is provided to the Holder when reserving sites.

  1. Food Safety
    1. If any food preparation takes place by the Holder applicable elements of the FDA Food Code and NPS Reference Manual 83A shall be followed.

  1. Employee List:
    1. The Holder shall provide a list of any employees operating under this authorization along with any certifications or licenses required or requested by the Government. The employee list shall be updated or confirmed as accurate no less than once per year.

Dog Sledding

  1. Definition of Services Authorized Under This Permit:
    1. Pickup, drop off, and transport of persons and equipment over the frozen lake surfaces of Rainy, Kabetogama, Namakan, and Sand Point Lakes via dogsled or similar dog propelled means.
    2. Supplying persons with accurate interpretive information about park resources and history.
    3. Supplying persons with appropriate winter clothing for the elements.
    4. Engaging in day hikes, day snowshoe excursions, or day ski excursions with clients.
  1. Prohibited Activities:
    1. Overland travel or backcountry travel across any landmass.
    2. Utilizing park-maintained ice roads or snowmobile trails for travel (except to cross at a direct 90-degree angle to utilize the frozen lake surface on the other side.
    3. Knowingly travelling upon ice that is inadequate for the weight of equipment utilized for the authorized activity.
    4. Interfering in the use and enjoyment of park areas by visitors not utilizing the services of the Holder.
    5. Soliciting business of any kind within park boundaries.
  1. Bedding: Only woodchips and blankets/tarps are to be utilized for bedding.

  2. Staking Dogs: Dogs on overnight trips are to be staked to the frozen lakebed in a manner that does not damage vegetation or shoreline.

  3. Vaccination Documentation: Health paperwork for each sled dog (including all vaccination types and dates) must be provided for each dog annually before the first tour of the season. All dogs must have and maintain current vaccinations against rabies, canine parvovirus, and canine distemper.

  4. Dog Health: Dogs found to be ill may not enter the park until they have received treatment and are in a healthy condition.

  5. Wildlife Conflicts: Any conflicts with park wildlife are to be reported to Voyageurs National Park within 24 hours by email, phone call, or face to face communication with a law enforcement ranger or the Superintendent.

  6. Waste Disposal: Dog waste shall be collected and disposed of in a trash receptacle.

  7. Safety:
    1. Holder must maintain a CPR and First Aid certification at minimum and will supply certifications upon demand.
    2. Holder will maintain a basic first aid kit and shall carry it on all trips exceeding 0.5 miles from the embarkation point.
    3. Holder will keep at least one form of reliable communication such as a marine radio, cellular phone with reliable service at all locations to be travelled, satellite phone, locator beacon, or other communication device on their person at all times while on a trip.

    6. Guide to client ratio shall not exceed 6 clients to 1 guide during trips.
    7. Holder may not split up a larger group into smaller and closely following groups to stay below the 6-client maximum limit during trips.
    8. Any split of groups must have their own guide and be no closer than 0.5 miles from any associated group.
    9. Holder will practice good outdoor ethics, including properly disposing of all human waste and also not leaving any garbage or refuse.

Snowmobile/Snowcat Tours

  1. Definition of Services Authorized Under This Permit:
    1. Pickup, drop off, transport, and guiding of persons via snowmobile for the purpose of sightseeing, viewing wildlife, viewing dark skies, learning about park resources or history, visiting destination sites, or similar general touring activities.
    2. Supplying persons with accurate interpretative information about park resources and history.
    3. Supplying clothing appropriate to winter conditions.
    4. Supplying helmets appropriate for snowmobile use.
    5. Engaging in day hiking, day snowshoe expeditions, or day ski expeditions with clients.
    6. Towing of damaged or inoperable snowmobiles owned or leased by Holder.
    7. Incidental towing of disabled snowmobiles not owned or leased by Holder provided such does not significantly interfere with the purpose of the activity.

  1. Prohibited Activities:
    1. Operating or renting unregistered snowmobiles.
    2. Operating or renting, under this authorization, vehicles which do not meet the National Park Service definition of a snowmobile.
    3. Interfering in use and enjoyment of park areas by visitors not utilizing services of the Holder.
    4. Advertising specific trip times or locations on a set schedule.
    5. Soliciting business of any kind within Park boundaries.

  1. Snowmobile Definition: A self-propelled vehicle intended for travel primarily on snow, having a curb weight of not more than 1000 pounds, driven by a track or tracks in contact with the snow, and steered by ski or ski in contact with the snow.

  2. Safety:
    1. Holder is required to provide orientation--either via video or in person--on snowmobile operation before each tour to include at minimum:
      1. Basic snowmobile operation
      2. Basic navigation
      3. A briefing on trail rules and etiquette
    2. Holder shall provide a safety briefing--either via video or in person--prior to each trip. Each safety briefing must include at minimum:
      1. Winter survival in a subzero wilderness environment.
      2. Expected weather conditions for the duration of the trip.
    3. Holder shall not rent snowmobiles for use within the Park until ice conditions are adequate to support the weight of the snowmobile and rider.
    4. Holder shall report any incidence of a snowmobile breaking through the frozen lake surface to a law enforcement ranger or the Superintendent within 24 hours of the incident occurrence.

  1. Equipment Condition:
    1. All snowmobiles shall be in good working order with fluids topped off prior to all trips.
    2. A visual inspection to ensure snowmobiles are free of damage which would or will render them unsafe or inoperable must be conducted prior to each trip.

  1. Closures and Public Use Limits: Voyageurs National Park retains the right to close any landing or associated area during emergencies, floods, or other unforeseen situations. In the event the National Park Service closes a National Park Service-controlled area, the Commercial Use Authorization (CUA) holder (Holder) is not permitted to use the closed portion of the controlled area for any reason.   1. Definition of Services Authorized Under This Permit:
    1. Ski and Snowshoe Rental
      1. Supplying skis, snowshoes, and associated equipment for use within park boundaries.
      2. Drop off of equipment within park boundaries.
      3. Pickup of equipment within park boundaries.
    2. Snowmobile/Snowcat Rental and Support
      1. Rental of snowmobiles for use within the park.
      2. Drop off of snowmobiles within park boundaries.
      3. Recovery of snowmobiles from within park boundaries.
      4. Supplying clothing appropriate to winter conditions.
      5. Supplying helmets appropriate for snowmobile use.
      6. Minor repair of snowmobiles within the park to include battery replacement, minor fuel system repair, minor drive system repair, track adjustment, suspension adjustment, and belt replacement.
      7. Towing of damaged or inoperable snowmobiles owned or leased by Holder.
      8. Incidental towing of disabled snowmobiles not owned or leased by Holder.

  1. Prohibited Activities:
    1. Interfering in use and enjoyment of park areas by visitors not utilizing services of the Holder.
    2. Supplying a guide to take clients to destinations.
    3. Soliciting business of any kind within Park boundaries.
    4. Operating or renting unregistered snowmobiles.
    5. Operating or renting, under this authorization, vehicles which do not meet the National Park Service definition of a snowmobile found in 36 CFR§ 1.4
    6. Completing repairs which will cause more than nominal fluid loss wtihin park boundaries.
    7. Towing at speeds or in a manner which is likely to cause damage to equipment or park resources.

  1. General Safety
    1. The Holder shall provide ice picks to all customers utilizing equipment within park boundaries prior to the establishment of the first snowmobile trail within the park for the season.
    2. The Holder shall provide a safety briefing to all customers.
    3. The safety briefing may be in person, over the phone, or via video call and shall include at minimum:
      1. Expected weather conditions for the duration of the trip.
      2. Information on proper clothing given the activity and weather.
      3. Basic navigation training.
      4. Training on use of ice picks if they are provided.

  1. Snowmobile Safety
    1. Holder is required to provide orientation, either via video or in person, on snowmobile operation to include at minimum:
      1. Basic snowmobile operation
      2. Basic navigation
      3. A briefing on trail rules and etiquette
    2. Holder shall provide a safety briefing, either via video or in person, to include at minimum:
      1. Winter survival in a subzero wilderness environment.
      2. Expected weather conditions for the duration of the trip.
    3. Holder shall not rent snowmobiles for use within the Park until ice conditions are adequate to support the weight of the snowmobile and rider.
    4. Holder shall report any incidence of a vehicle breaking through the frozen lake surface to a law enforcement ranger or the Superintendent within 24 hours of the incident occurrence.
  1. Equipment Condition
    1. All rented equipment must be in good working condition and free of any defects, damage, or disrepair that will cause, or be likely to cause, the equipment to become non-operational.
    2. A visual inspection of all rented equipment must be completed prior to each trip. Any damage or deterioration shall be evaluated and mitigated if required prior to departure.
  1. Equipment Recovery:
    1. Equipment left by customers of the Holder within the park must be recovered as soon as practicable.
    2. Equipment must be removed from the park within 12 hours of drop-off by customer.
      1. Equipment being used by customers of the Holder for multiple-day trips are exempt from conditions for recovery while being used in conjunction with a valid camping permit at campsites where a reservation is held.
    3. Equipment left unattended upon park lands or waters for 24 hours will be considered abandoned and seized.
    4. NPS staff and volunteers will not take possession of, or safeguard, equipment left by customers.
    5. Equipment may not be stored in visitor centers, parking lots, or other government buildings or land.

  1. Registration: All snowmobiles shall have current unexpired registration and documentation of such must remain with the snowmobile while within park boundaries.

  2. Employee List:
    1. The Holder shall provide a list of any employees operating under this authorization along with any certifications or licenses required or requested by the Government. The employee list shall be updated or confirmed as accurate no less than once per year.

  1. Closures and Public Use Limits: Voyageurs National Park retains the right to close any landing or associated area during emergencies, floods, or other unforeseen situations. In the event the National Park Service closes a National Park Service-controlled area, the Commercial Use Authorization (CUA) holder (Holder) is not permitted to use the closed portion of the controlled area for any reason. No reimbursement for canceled reservations will be provided to the Holder.

  2. Subject to Change: All stipulations and conditions herein are subject to change without written notice, and without compensation to the Holder or liability to the United States. There is no appeal process.

  3. Revocation or Suspension: At the discretion of the Superintendent, the authorization may be canceled or suspended at any time for any length of time without compensation to the Holder or liablity to the United States. Any appeal process will be made available to the appropriate party if a CUA is suspended, terminated, etc.

  4. Non-compliance or Non-adherence: Failure to comply with any of the Special Park Conditions of the Commercial Use Authorization per 54 USC sec 101925 may result in the immediate suspension or termination or non-renewal of the Holders' application by the Superintendent. There is no appeal process to this determination.

  5. Carrying Commercial Use Authorization at All Times: Holder shall ensure that each of their employees receives a copy of the authorization and understands the content, conditions, and stipulations. Additionally, Holder ensures the signed Authorization, or at a minimum, the park specific conditions section, will be carried by the Holder and/or their employees. The National Park Service retains the right for the CUA Program Manager, Superintendent, Law Enforcement Park Rangers, and any other person designated by the CUA Program Manager to request an Authorization check at any time on National Park Service jurisdiction, including during peak use. Holder or employees may carry CUA cards printed by the Park in lieu of the full authorization in order to prove they possess a valid authorization if checked by NPS staff.

  6. Accidents: CUA staff must notify law enforcement staff immediately following any accident (considered reportable by law) or injury (beyond basic first aid) by calling the Natilnal Park Service Emergency Dispatch at (440) 546-5945. All accidents, including near misses, must be reported on the Annual Report (Form 10-660).

  7. Payment Rendered for Services: Holder and their employees are not permitted to collect any form of payment on National Park Service property for any reason.

  8. Vessel Inspections: Vessels used in providing services under this permit may be inspected by NPS personnel to evaluate safety and condition.

  9. Annual Report: A complete annual report must be submitted by season end or February 15, whichever comes first, of each year. Failure to provide an Annual Report by established deadlines will be grounds for suspension or denial of future applications.

Ice Fishing Shelter and Equipment Rental
(In-Park CUA)

  1. Definition of Services Authorized Under This Permit:
    1. Placement and removal of ice fishing shelters on frozen lake surfaces.
    2. Supplying ice fishing shelters for use upon frozen lake surfaces.
    3. Supplying fishing equipment to include rods, lines, bait, lures, spears, augers, ice saws, ice scoops, ice chisels, or other associated equipment.
    4. Providing portable toilet facilities for use upon frozen lake surfaces.
    5. Transport of clients to ice fishing shelters.
    6. Transport of live or dead fish in a manner and quantity allowed by state law.

  1. Prohibited Activities:
    1. Violating any state or federal law related to fish and wildlife.
    2. Knowingly allowing or encouraging a guest, customer, or visitor to violate any fish and wildlife laws.
    3. Utilizing an unregistered and/or uninsured vehicle to tow ice shelters or transport customers.
    4. Placing shelters on ice before ice thickness and quality is adequate to support the weight of the shelter, towing equipment, and operator.
    5. Pumping of blackwater within the park.
    6. Staking trails within park boundaries.

  1. Safety:
    1. Holder shall not place or rent ice fishing shelters on frozen lake surfaces until ice is of sufficient thickness to support the shelter, equipment used to place the same, and users of the shelter.
    2. Holder shall be familiar with ice rescue and shall keep ice picks upon their person while placing, moving, or removing ice shelters.
    3. Holder shall report any incidence of a vehicle or shelter breaking through the frozen lake surface to a law enforcement ranger or the Superintendent within 24 hours of the incident occurrence.

  1. Shelter Placement:
    1. Ice fishing shelters may not be placed in areas of known thin or dangerous ice.
    2. Ice fishing shelters must comply with State of Minnesota regulations regarding registration and placement.
    3. Shelters must be placed a specified distance from any snowmobile trail or ice road as specified in the Superintendent's Compendium for the park.
    4. Ice fishing shelters may be left in the park for the duration of the ice fishing season.
      1. Leaving shelters in the park meets the definition of an “In Park” activity.

  1. Gross Receipt Limit: Leaving shelters in the park unoccupied for more than 24 hours makes this activity an “In Park” CUA activity. The Holder may not exceed $25,000 in gross receipts from the approved activity.

  2. Transport Vehicles:
    1. Vehicles used to place shelters or transport clients must be registered and insured.
    2. No unregistered vehicles or equipment to include agricultural equipment, unregistered street legal vehicles, unregistered off-road vehicles, unregistered snowmobiles, or other unregistered vehicles may operate within the park.
    3. Vehicles and snowmobiles shall only travel in locations where allowed by federal regulation.
    4. When transporting clients to shelters the most direct legal route to and from the shelter must be taken unless unsafe conditions require deviation.

The National Park Service retains the right for the CUA Program Manager, Superintendent, law enforcement Park Rangers, and any other person designated by the CUA Program Manager to request an Authorization check at any time on National Park Service property, including during peak use.

  6. Accidents: CUA staff must notify law enforcement staff immediately following any accident or injury by calling the National Park Service Emergency Dispatch at (440) 546-5945. All accidents, including near misses, must be reported on the Annual Report (Form 10-660).

Mukooda Lake Non-Motorized Boat Rental
(In-Park CUA)

  1. Definition of Services Authorized Under This Permit:
    1. This activity is applicable to Mukooda Lake only.
    2. Providing up to three total (3) kayaks, canoes, or stand-up paddleboards; OR up to one (1) rowboat or small sailing vessel for use.
    3. Recovering or towing damaged or unserviceable vessels owned or leased by Holder.

  1. Prohibited Activities:
    1. Use or rental of any power-driven vessel in or upon the waters of Mukooda Lake.
      1. Both internal combustion and electric motors are prohibited.
    2. Violating any laws or regulations related to vessel use, safety, or registration.
    3. Interfering in use and enjoyment of park areas by visitors not utilizing services of the Holder.
    4. Supplying a guide to take clients to destinations.
    5. Constructing any permanent, non-moveable storage racks or boxes for vessel or equipment storage.
    6. Transferring vessels or other equipment into or upon Mukooda Lake which have been in infested waters without undergoing decontamination procedures.
    7. Use of any personal watercraft (i.e., jet ski, wave runner) in the course of providing authorized services.
    8. Soliciting business of any kind within Park boundaries.

  1. Gross Receipt Limit:
    1. As an “In Park” activity, the Holder may not exceed $25,000 in gross receipts from the approved activity.

  1. Safety:
    1. Vessels must be in good condition with no visible cracks, holes, or other defects which can cause the vessel to take on water or otherwise be deemed unfit for operation.
    2. The Holder is required to ensure a serviceable and well-fitting personal flotation device is available for each client.

  2. Vessel and Equipment Storage:
    1. Vessels and equipment may remain on the shoreline of Mukooda Lake in designated areas on Holder provided or Park provided storage racks/boxes.

  1. Vessel Orientation:
    1. The Holder shall train and orient customers on safe use of the vessel to be utilized.
      1. Training may be in person or via video and shall include at a minimum:
        1. Basic paddle strokes (if the vessel is propelled by paddle)
        2. Basics of sailing (if vessel is wind-propelled)
        3. Special vessel features and operation
        4. Basics of self-rescue
        5. Basic navigation

  1. Safety Briefing:
    1. The Holder shall provide a safety briefing to all customers.
      1. The safety briefing may be in person, over the phone, or via video call and shall include at minimum:
        1. Expected weather conditions for the duration of the trip
        2. Navigation hazards
        3. Basic water safety information
  1. Aquatic Invasive Species:
    1. The Holder of this authorization shall ensure that all vessels, trailers, or other equipment utilized are not exposed to contaminated or infested waters.
    2. The Holder shall instruct customers that all vessels and equipment used on Mukooda Lake must not be used on or in any other body of water to reduce the risk of transferring invasive species into Mukooda Lake.

  1. Employee List:
    1. The Holder shall provide a list of any employees operating under this authorization along with any certifications or licenses required or requested by the Government. The employee list shall be updated or confirmed as accurate no less than once per year.
