In accordance with the regulations and delegated authority provided in TITLE 36, Code of Federal Regulations (36 CFR), Chapter 1, Parts 1-7, authorized by Title 54 United States Code 100751, the following provisions apply to all lands and waters administered by the National Park Service within the boundaries of Jean Lafitte National Historical Park and Preserve (Jean Lafitte NHP&P) and New Orleans Jazz National Historical Park (New Orleans Jazz NHP). Unless otherwise stated, these regulatory provisions apply in addition to requirements contained within 36 CFR, Chapter 1, Parts 1-7. As required by 36 CFR Section 1.5(c), written justifications have been provided to explain the reasoning behind the Superintendent’s use of discretionary authority.
Policy on Closed Circuit Television (CCTV)
Jean Lafitte National Historical Park and Preserve (Jean Lafitte NHP&P) and New Orleans Jazz National Historical Park (New Orleans Jazz NHP) utilize CCTV in accordance with National Park Service (NPS) Law Enforcement Reference Manual 9 Chapter 26. The NPS use of Closed-Circuit Television (CCTV), for law enforcement and security purposes, will only be to visually monitor public park areas and public activities, where no constitutionally protected reasonable expectation of privacy exists. Such CCTV use – which will have adequate privacy and First Amendment safeguards – is to help ensure public safety and security; facilitate the detection, investigation, prevention, and deterrence of terrorist attack and crime; help ensure the safety of citizens and officers; help assist in the proper allocation and deployment of law enforcement and public safety resources; and help facilitate the protection of the innocent and the apprehension and prosecution of criminals. See Appendix A for more information.
Signs providing the public notice are displayed at all sites utilizing CCTV.
36 CFR Part 1-General Provisions
1.5 (a)(1) Operating Hours
The hours of operation are subject to change due to inclement weather, emergencies, or special events. Notice of change to the hours of operation will be posted on the Jean Lafitte NHP&P Website and the New Orleans Jazz NHP website in accordance with 36 CFR 1.7.
Jean Lafitte National Historical Park and Preserve All sites are closed for federal holidays and Mardi Gras* unless otherwise stated.

New Orleans Jazz National Historical Park New Orleans Jazz National Historical Park Visitor Center operations have moved to Laura C. Hudson Visitor Center (419 Decatur St. New Orleans, LA 70130) Open Tuesday-Saturday 9:30 am to 4:30 pm.
*Closures for Mardi Gras are determined annually based on site accessibility and safety for visitors and employees. Announcements will be posted accordingly.
1.5 (a)(1) Closures
Within all areas administered by Jean Lafitte National Historical Park and Preserve and New Orleans Jazz National Historical Park, the following activities are prohibited. This section may be duplicative with other sections in this compendium. This section summarizes all closures which may be a result of other Code of Federal Regulations discussed separately.
Camping is prohibited except with an approved permit issued by the Superintendent. Justification: There are no developed camping areas for public use. A permit issued by the Superintendent is required for camping inside the parks to limit damage to natural and cultural resources.
Picnicking is prohibited in non-designated areas. Justification: Picnicking is limited to designated areas to limit the damage to natural and cultural resources.
Leaving a trail or walkway: Going off of a designated trail or walkway in the Barataria Preserve is prohibited, except within designated hunt zones or by authority of a Special Use Permit issued by the Superintendent’s office. Justification: In order to protect fragile park resources, visitors must remain on designated trails in the undeveloped areas of the Barataria Preserve. Hunters are permitted to be off trail in the designated hunt zones. Special Use Permits authorizing researchers to leave the trails may be granted by the Superintendent.
Mooring or grounding of any watercraft over 25 feet in length is prohibited within any waters administered by Jean Lafitte NHP&P. Justification: Large watercraft running aground or mooring have caused considerable resource damage and greatly increased erosion along park waterways, to include damaging archeological sites. Prohibiting large watercraft from mooring or running aground is necessary to protect resources.
Operating a combustion motorized vessel or airboat is prohibited in the following areas of the Barataria Preserve. Paddling, poling, and electric tolling motors are permitted.

Bayou Coquille
Twin Canals
Parallel Canal
Kenta Canal
Pipeline Canal, as posted
Tarpaper Canal, as posted
Vessels with combustion motors are permitted on the waterways, if the motor(s) are turned off and tilted up, so as to be out of the water or removed from the transom or gunnels.
Justification: Closing these waterways to motorized boat use by the public limits bank erosion and disturbance to anglers, enhances the safety of park visitors in canoes or pirogues, and enhances the visitor experience by providing an area free from mechanical noise.
Parking a vehicle in a non-designated spot or inside a gated lot outside of posted operating hours is prohibited. The following exception applies: vehicles may be parked outside of a gated area when the vehicle is parked on the shoulder, completely off of the roadway, and does not hinder emergency vehicle access. Justification: Prohibiting vehicles from remaining parked inside gated areas after posted hours provides a reasonable amount of protection for park property, resources and reduces potential liability.
Operating a vehicle in any other area closed to vehicular traffic is prohibited including, but not limited to, sidewalks, trails, old roadbeds, the Mississippi River Road at Chalmette Battlefield and National Cemetery, and utility access corridors. Justification: Prohibiting public use on these roads allows for ease of official access, promotes safety, and limits damage to the resources.
Recreational activities at the Chalmette Battlefield and National Cemetery are prohibited.
This includes but is not limited to:
Games (football, baseball, frisbee, soccer, golf)
The use of rollerblades, skates, skateboarding, hoverboarding
Operating model cars or planes
Justification: These activities are prohibited to protect the historic integrity of the Battlefield and National Cemetery, promote safety, and provide for an accurate historical experience for park visitors.
Public use of the batture at Chalmette National Cemetery and Battlefield for any reason is prohibited. The batture is defined as the alluvial area from the low water mark of the river to the levee. Justification: The use of the batture is unsafe and could result in injury or death.
Soliciting, sleeping, panhandling, or playing “street games” is prohibited to include, but not limited to, asking for money, harassing park visitors or employees, loitering, or requesting money for merchandise or services. Justification: Prohibiting these activities allows for the public to visit the park without being harassed or intimidated into giving money or having to walk around a person sleeping.
Securing personal property to park facilities is prohibited with the exception of, bicycles which may be secured to bicycle racks. Justification: The securing of personal property to park facilities not designed for this purpose can cause damage to park facilities/resources and can pose a safety hazard to members of the public.
Use of park facilities for washing and drying of persons or personal effects is prohibited. Justification: The use of park sinks, fountains, and restroom facilities for bathing can pose a public health hazard, damage park facilities, and prevent other members of the public from using the facilities.
Use of unmanned aircraft is prohibited. The term, unmanned aircraft means, a device that is used or intended to be used for flight through the air without the possibility of direct human intervention from within or on the device. This term includes all types of devices that meet this definition (e.g., model airplanes, quadcopters, and drones) that are used for any purpose, including for recreation or commerce. Justification: The use of flying unmanned aircraft has negative impacts in the park including frightening/disturbing wildlife, impacting the park visitor experience, and presenting public safety hazards.
Public access to administrative or employee only areas of government facilities is prohibited. Persons conducting official business must be escorted and register using the visitor accountability log. Justification: For employee safety, information protection, and ensuring the safety of government and private property, members of the public are not permitted into administrative or employee spaces without signing an access log and being escorted by an employee.
Public access to the Malus-Beauregard House at the Chalmette Battlefield is prohibited. Justification: In the interest of public safety, the building is closed to public use.
1.5(a)(2) Public Use Limits
The following activities are permitted within designated areas subject to the following conditions or restrictions.
Mask Wearing Requirements; Face Coverings
Low or Medium Community Level - When the COVID-19 Community Level is LOW or MEDIUM in the county or all the counties where the park is located based on data provided by the Centers for Disease Control and Prevention (CDC), individuals are not required to wear masks.
High Community Level - When the COVID-19 Community Level is HIGH in the county or all the counties where the park is located based on data provided by the CDC, all individuals over the age of two must wear masks, regardless of vaccination status, in all common areas and shared workspaces in buildings owned, leased, or otherwise controlled by the National Park Service, including, but not limited to, park visitor centers, administrative offices, lodges, gift shops and restaurants.
High Community Level County Specific - When the COVID-19 Community Level is HIGH in one or more, but not all, of the counties where the park is located based on data provided by the CDC, the superintendent will determine whether individuals are required to wear masks. The requirement, if any, will apply to all facilities within the park.
Masks must cover the nose and mouth and fit snugly around the nose and chin with no large gaps around the sides of the face. Masks not designed to be protective, masks with ventilation valves, and face shields do not meet the requirement.
Regardless of the COVID-19 Community Level, individuals may wear masks if they choose to do so.
Where a state, local, tribal, or territorial government where the park is located imposes more protective mask-wearing requirements than those indicated by the COVID-19 Community Level, individuals must follow those more protective requirements within the park.
More protective state, local, tribal, or territorial mask-wearing requirements are hereby adopted as federal requirements in all units of the National Park System located within that state, locality, area subject to a federally recognized Indian tribe’s regulatory jurisdiction, or territory, regardless of a particular park’s jurisdictional status.
Justification: To protect the health and safety of NPS employees, volunteers, partners and contractors, and park visitors, must follow guidance in accordance with Centers for Disease Control and Prevention guidelines regarding face coverings to protect against the spread of COVID-19.
Filming
The organizer of any filming activity with more than five (5) persons and/or any equipment outside of a camera that is carried at all times or a small tripod holding a camera, shall notify the park through written notification at least ten (10) days prior to the start of the proposed activity. Based upon the information provided, the Superintendent may require the organizer to apply for and obtain a permit, if necessary, to:
Maintain public health and safety;
Protect environmental or scenic values;
Protect natural or cultural resources;
Allow for equitable allocation and use of facilities; or
Avoid conflict among visitor use activities
If the Superintendent determines that the terms and conditions of a permit could not mitigate the concerns identified above in an acceptable manner, the Superintendent may deny a filming request without issuing a permit. The Superintendent will provide the basis for denial in writing upon request.
The NPS will consider requests and process permit applications in a timely manner. Processing times will vary depending on the complexity of the proposed activity. If the organizer provides the required 10-day advance notice to the NPS and has not received a written response from the NPS that a permit is required prior to the first day of production, the proposed filming activities may occur without a permit.
The following are prohibited:
Engaging in a filming activity without providing advance notice to the Superintendent when required.
The Superintendent has notified the organizer in writing that a permit is required.
Violating a term and condition of a permit issued under this action.
Violating a term or condition of a permit issued under to this action may also result in the suspension and revocation of the permit by the Superintendent.
Electric Personal Assistive Mobility Devices (EPAMD);
i.e., Segways are permitted when used by mobility impaired persons in the same manner as a motorized wheelchair.
Operators of EPAMDs are subject to the following conditions:
Operational speed shall be limited to a maximum of four (4) miles per hour in park areas.
Operators shall have the rights and responsibilities of a pedestrian while travelling on a sidewalk, trail, or other pedestrian areas. Operators shall exercise due care to avoid colliding with other pedestrians and shall yield the right of way to other pedestrians.
Operators shall be at least 16 years of age.
EPAMDs are permitted on boardwalks, paved trails, and inside visitor centers.
EPAMDs are not permitted on non-improved trails.
Justification: EPAMDs can increase the number of park areas accessible to mobility impaired persons. For the safety of other park visitors and the protection of park resources such devices must be operated with due care.
36 CFR 1.6-Permits
1.6 (a) Permits
When authorized by regulations set forth in 36 CFR Chapter 1, the Superintendent may issue a permit to authorize an otherwise prohibited or restricted activity or impose a public use limit. The activity authorized by a permit shall be consistent with applicable legislation, Federal regulations and administrative policies, and based upon a determination that public health and safety, environmental or scenic values, natural or cultural resources, scientific research, implementation of management responsibilities, proper allocation and use of facilities, or the avoidance of conflict among visitor use activities will not be adversely impacted. Certain park facilities may be available for use with a special use permit Any questions regarding permits or requests for a special use permit should be directed to the permit coordinator at 504-292-7325. Applications for special use permits are available at Permits & Reservations - Jean Lafitte National Historical Park and Preserve (U.S. National Park Service) (nps.gov).
The Superintendent may authorize use of park facilities for approved special use permits. Park facilities are reserved on a first come first served basis. The permit may require the payment of cost recovery charges and proof of liability insurance in addition to the non-refundable permit application fee. The following park facilities are available for public use with a special use permit:
ACC- Lafayette Visitor Center Theater PACC – Eunice Demonstration area WACC – Thibodaux Theater and Demonstration area Barataria Preserve Visitor Center Theater and Education Center Chalmette Battlefield Visitor Center Chalmette Room and the Malus-Beauregard House Laura C. 1.6(f) Activities Requiring a Permit
Permits are issued by the Superintendent and may be subject to special requirements. Engaging in these activities without a permit or violating the terms and conditions of a permit is prohibited. The following is a list of activities and applicable 36 CFR statutes for which a permit is required.
1.5(a)(2) Historic activities and living history demonstrations:
Park sponsored historic activities and living history demonstrations are permitted. All other historic activities and living history demonstrations require an approved permit issued by the Superintendent. Justification: The use of historic replica weapons, living history encampments, the use of pack animals for living history, and other living history activities may pose a risk to public safety and potential damage to park resources and facilities. Park oversight of such activities through the permitting process mitigates such risks. All historic black powder weapons and users must follow the standards established by NPS Director’s Order 6 and Reference Manual 6.
2.2(b)(2) Hunting: A hunting permit issued by the park is required in addition to any applicable State of Louisiana licenses and permits. Justification: Hunting is a traditional use of the Barataria Preserve and is protected by the park’s enabling legislation, Public Law 95-625 as amended. In order to preserve this traditional use and protect visitors, hunters, and park resources, the park has established designated hunting zones and additional regulations. 2.2.2(b)(3) Trapping: A trapping permit issued by the Superintendent is required in addition to any applicable State of Louisiana licenses and permits. Justification: Trapping is a traditional use of the Barataria Preserve and is protected by the park’s enabling legislation, Public Law 95-625 as amended. In order to preserve this traditional use and protect visitors, trappers, and park resources, the park has established designated trapping zones and additional regulations. For a trapping permit, contact the park at e-mail us or 504-589-3882 ext. 18.
2.2.3(d)(4) Commercial Fishing: A commercial fishing permit issued by the Superintendent is required in addition to any applicable State of Louisiana licenses and permits. A commercial fishing permit is subject to a minimal charge to cover the cost of processing the permit application. Justification: Commercial fishing is a traditional use of the Barataria Preserve and is protected by the park’s enabling legislation, Public Law 95-625 as amended. In order to preserve this traditional use and protect park resources, the park has established conditions concerning gear used and species taken. Contact the park at e-mail us or 504-292-7325 for additional information and to apply for a commercial fishing permit.
2.5(a) Specimen collection: A permit is required for collecting any natural (plants, fish, wildlife, rocks, or minerals) or cultural resource (archeological, ethnographic, or historical). A permit is required for collection of resources as part of a scientific or cultural research project. Scientific or cultural researchers should contact the park’s research coordinator at 504-292-7325 for guidance on NPS research related permits.
2.10(a) Camping: An approved permit is required to camp overnight.
2.17(a)(3) Aircraft and air delivery: A permit is required for delivery or retrieval of a person or object by parachute, helicopter, or other airborne means.
2.17(c)(1) Removal of downed aircraft: A permit is required for the removal of a downed aircraft.
2.38(a) Explosives: A permit is required for use, storage, or transporting any explosive or blasting agent. Justification: All black powder use and storage must be in compliance with the standards established by NPS Director’s Order 6 and Reference Manual 6.
2.50(a) Special Events: A permit is required for any sports event, pageants, regattas, public spectator events, entertainment, ceremonies, or similar events.
2.51(a) Demonstrations: A permit is required for public assemblies, meetings, demonstrations, or other first amendment protected activities for groups consisting of 25 or more participants. See Superintendent’s Orders section 36 CFR 2.51(a) for the location of areas designated for demonstrations.
2.52(b) Sale or distribution of printed matter: A permit is required for the sale or distribution of printed matter by groups of 26 or more individuals. Distribution or sale of matter that is solely commercial advertising is not allowed. Printed matter may only be distributed in areas designated as available for distribution under 36 CFR 2.51(c)(2). See Superintendent’s Orders section 36 CFR 2.52 for the location of areas designated for the sale or distribution of printed matter.
2.61 Residing on federal lands: A permit is required to reside on federal lands.
2.62(b) Memorialization of human remains: A permit is required for the scattering of human ashes from cremation. Requests for the scattering of human remains will be handled on an individual/case-by-case basis. Arrangements are requested through the special use permit process.
5.1 Advertisements: A permit is required for displaying, posting, or distributing advertisements.
5.3 Business operations: Engaging in or soliciting any business in park areas requires accordance with the provisions of a permit, contract, or other written agreement with the United States, except as such may be specifically authorized under special regulations applicable to a park area.
5.7 Construction of buildings or other facilities: A permit is required for the construction of buildings, facilities, trails, roads, boat docks, paths, etc.
36 CFR PART 2-Resource Protection, Public Use and Recreation
36 CFR 2.1 Preservation of natural, cultural and archaeological resources
2.1(c)(1) Gathering of natural products for personal use and consumption: Only the natural items listed may be gathered.
Up to one (1) gallon per person of the following natural products may be gathered per day for personal use and consumption: Dewberries and blackberries (Rubus sp.), muscadine and other wild grapes (Vitaceae), elderberries (Sambucus canadensis), mulberries (Morus ssp.), pecans (Carya illinoiensis), pomegranates (Punica granatum). Up to one (1) quart per person of the following natural products may be gathered per day for personal use and consumption: edible mushrooms, thistles, maypops (Passiflora horridulum), persimmons (Diosoyros virginiana), and wild onions (Allium canadense).
36 CFR 2.2 Wildlife protection
2.2 (a)(1) Protected species: All reptile and amphibian species are protected within the park. Exceptions listed in Fishing Section.
2.2 (a)(2) Prohibited use: All areas of the park are closed to the use of manual animal calls of any type, and the use of recordings for the purpose of attracting and viewing wildlife. Exception: For the calling of game species during legal hunting season, or as part of park sanctioned research activities.
36 CFR 2.2(b) Hunting
Hunting is permitted only at times and places specifically identified in the Park’s regulations. The hunting permit is issued under the provisions of 36 CFR 2.2(b). Valid use of the issued hunting permit is subject to the hunter’s compliance with:
all park specific regulations listed on the permit,
all non-contradictory State of Louisiana hunting regulations, and
all regulations contained within 36 CFR 2.2(b)(1) and (b)(3).
2.2(b)(1) Wildlife that may be lawfully hunted: The following species may be legally hunted in designated hunting areas with a valid hunting permit and Louisiana State hunting license: White Tailed Deer (Odocoileus virginianus), Gray Squirrel (Sciurus carolinensis), Swamp Rabbit (Sylvilagus aquaticus), Feral Hog (Sus scrofa), Nutria (Myocastor coypus), and migratory game birds and waterfowl (per established waterfowl and game species listed at Migratory Birds Regulations - Louisiana Hunting | eRegulations. Also See 50 CFR part 20 for more information). Justification: The listed species have been traditionally hunted in the Barataria Preserve by means that do not cause unacceptable damage to park resources. Note that not all species authorized for hunting in the State of Louisiana are authorized for hunting in the Barataria Preserve.
2.2(b)(3) Wildlife that may be lawfully trapped: The following species may be legally trapped within designated trapping areas with a valid park trapping permit and Louisiana state trapping permit: Nutria (Myocastor coypus), Common Muskrat (Ondatra zibethicus), Raccoon (Procyon lotor), American Mink (Vison vison), North American River Otter (Lutra canadensis), and Virginia Opossum (Didelphis virginiana). Justification: The listed species have been traditionally trapped in the delta region and have populations that can sustain a regulated harvest. The permit system is necessary to regulate the harvest in a sustainable manner and assist in gathering scientific data. Note that not all species authorized for hunting in the State of Louisiana are authorized for hunting in the Barataria Preserve.
2.2(e) Viewing wildlife with artificial light: Viewing wildlife with artificial light is prohibited except when engaged in park sanctioned activities within all areas of the park. Justification: The use of artificial light to view wildlife interferes with animal navigation, and essential natural activities such as hunting and mating. Artificial light disturbs wildlife including insects and could cause them to injure themselves when trying to escape the source of light. Artificial light pollutes the night skies negatively impacting visitors seeking to enjoy night sky viewing
36 CFR 2.3 Fishing
2.3(a)Fishing or engaging in related activities, like crabbing is permitted in the Barataria Preserve subject to the following conditions:
All reptile species are protected in the park and may not be harvested, collected, disturbed or possessed while within the park. This applies to all lizards, snakes, turtles, alligators, and related species.
All reptile species are protected in the park and may not be harvested, collected, disturbed or possessed while within the park, except American Bullfrog (Lithobates catesbeianus), and Pig Frog (Lithobates grylio), amphibian species that are authorized by the state of Louisiana and may be taken within Barataria Preserve in accordance with state fishing regulations. This applies to all other frogs, toads, salamanders and related species.
Anglers must otherwise comply with all State of Louisiana fishing regulations.
Bank anglers may only fish from, or access fishing areas from the Jones Point Day Use Area, Twin Canals Area, and the Kenta Canal Area. All other trails, bridges, and canoe docks are closed to fishing.
The fisherman has a valid Louisiana State fishing license with a recreational crab trap endorsement.
The fisherman clearly marks the float of the crab trap with their name, phone number, and date last set.
The fisherman sets no more than ten (10) crab traps per licensed fisherman. Setting 11 or more crab traps is considered commercial crabbing under Louisiana State law and requires an NPS park permit.
The fisherman checks the crab traps at least twice a week.
The fisherman removes the crab traps when no longer tended.
Recreational crabbing possession limit is 12 dozen (144) crabs per person per day.
The baiting, tending, checking or removing of serviceable crab traps in use, the contents of such crab traps or their lines, buoys or markers is prohibited in public waters from one-half hour after legal sunset until one-half hour before legal sunrise.
Fishing is prohibited in the following areas of the Barataria Preserve:
Visitor Center and Visitor Center Trail
Palmetto Trail
Bayou Coquille Trail
Marsh Overlook Trail
Ring Levee Trail
Pecan Grove Canoe Launch Trail
From any vehicular bridge
Justification: The use of park trails to access fishing areas, fishing from bridges, and fishing from canoe docks presents significant safety concerns, fosters the accumulation of litter, and degrades park resources.
36 CFR 2.4 Weapons, traps, and nets
2.4(a)(i) Possession or Use of a Weapon is prohibited, except under the following conditions listed below. A weapon means a firearm, compressed gas or spring-powered pistol or rifle, bow and arrow, crossbow, blowgun, spear gun, hand-thrown spear, slingshot, irritant gas device, explosive device, paintball gun, airsoft gun, BB or pellet gun, or any other implement designed to discharge missiles. Justification: Due to the inherently dangerous situations that arise from projectiles emitted from firearms, paintball guns, BB guns, airsoft guns, and blow guns use of any of these instruments is prohibited. This is to ensure the safety of park visitors, employees, wildlife, and prevent damage to property and resources.
The following exceptions apply:
Legal possession of a firearm under the State of Louisiana laws is authorized, except in any government facility. People open carrying, or in possession of a valid concealed carry license, are not permitted to possess a firearm inside any government facility, i.e., visitor centers.
Legal possession and use of a firearm or other weapon is authorized during hunting season, in a designated hunting zone of the Barataria Preserve by legally permitted hunters. Additional regulations concerning hunting within the Barataria Preserve apply.
Possessing, carrying, or using a black powder historic weapon is permitted within the Chalmette Battlefield and National Cemetery with an approved permit issued by the Superintendent as part of a living history demonstration.
Possessing, carrying, storing, or transporting black powder is permitted with approval by the Superintendent as part of a living history demonstration.
2.4(b)(1)(iii) Hoop nets are prohibited: The use of a hoop net to capture fish is prohibited within all areas of the Barataria Preserve. Justification: Hoop nets have the potential to catch and kill large numbers of non-targeted species.
36 CFR 2.13 Fires
2.13(a)(1) Lighting fires: The lighting or maintaining of a fire is prohibited within all areas of the parks except on cooking grills in designated picnic areas. Justification: Fires are restricted to cooking grills in designated picnicking areas to limit the damage to park resources and facilities.
36 CFR 2.15 Pets
2.15(a)(1) Pets are prohibited within any facility such as visitor center, comfort station, courtyard, or trail as well as on the grounds of the Chalmette National Cemetery.The following exceptions apply, and, in all cases, the pet owner is responsible for cleaning up any pet excrement:
Service animals as defined by the Americans with Disabilities Act are authorized in park administered facilities.
Pets are authorized in parking lots while on a leash.
Pets are authorized while on a leash on the Chalmette Battlefield grounds, on the grounds of the three Acadian Cultural Centers in Thibodaux, Lafayette, and Eunice, and on the Barataria Preserve Visitor Center Deck.
36 CFR 2.21 Smoking
2.21(a) Smoking: The Superintendent may at any time prohibit smoking in an area when necessary to protect park resources, mitigate fire risk, protect employees and visitors from second hand (ETS) smoke exposure, and prevent conflict from among employees and visitors. Smoking is defined as the use and carrying of a lighted cigarette, cigar, pipe, electronic vaporizer, or other tobacco product. The Superintendent has designated the following areas closed to smoking:
All government owned or leased structures.
All government owned or leased vehicles, heavy machines, vessels, or tractors.
The parks’ headquarters carriageway, courtyard, and bathrooms.
Within 25 feet of any entrance or exit used by the public, or where smoking would result in smoke travelling through doorways, windows, air ducts, or other openings.
Justification: The listed areas are closed to smoking to protect park visitors and employees from the health hazards associated with smoking, and to mitigate damage to park resources caused by the careless burning and disposal of tobacco products. 2.21(a) Designated smoking areas: The following areas are designated smoking areas for employees, volunteers, and researchers:
Park Headquarters - the small gated area at the rear of the courtyard.
ACC – Lafayette - at the end of the low brick wall adjacent to the emergency parking area.
PACC – Eunice - covered front patio 25 feet from the main entrance.
WACC - Thibodaux - 25 feet from the theater greenroom entrance.
Barataria Preserve
Visitor Center - rear boardwalk 25 feet away from rear alternate office entrance.
Maintenance Facility - 25 feet from both the main entrance and the flammable material storage areas.
Education Center - 25 feet from the rear entrance of the facility.
Chalmette Battlefield and National Cemetery
Visitor Center - 25 feet from the side employee entrance.
Malus-Beauregard House - 25 feet from the main entrance of the building.
Carriage House and Superintendent’s Lodge - 25 feet from the main entrances of both buildings.
New Orleans Jazz NHP Visitor Center - 25 feet from the main entrance of the facility.
36 CFR 2.35 Alcoholic Beverages
2.35(a)(3)(i) Consumption of alcoholic beverages: The consumption of alcoholic beverages is prohibited within any land area or facility administered by Jean Lafitte NHP&P and New Orleans Jazz NHP. Alcoholic beverages may be permitted with a permit issued by the Superintendent. The consumption of alcoholic beverages on a vessel while afloat is permitted to the extent that the operator is not legally impaired.
36 CFR 2.50 Special Events
2.50(a) Sports events, pageants, regattas, public spectator attractions, entertainments, ceremonies and similar events are allowed, provided there is a meaningful association between the park area and the events, and the observance contributes to visitor understanding of the significance of the park area, and a permit therefore has been issued by the Superintendent.
36 CFR 2.51 Public assemblies, meetings
2.51(a) Designated available park areas. The following locations are designated as available for demonstrations under this section. These activities may require a permit and may not interfere with foot traffic or block any public entrance. Detailed maps of specific areas are available in Appendix B or upon request. 36 CFR 2.62 Memorialization
2.62(b) Memorialization of human remains: Arrangements for the scattering of human ashes from cremation are requested through the special use permit process and will be handled on an individual, case-by-case basis. See 36 CFR 12.5 and NPS Reference Manual 61 for additional information concerning interment in the Chalmette National Cemetery. Justification: Memorialization under specific conditions is necessary for the protection of natural resources, implementation of management responsibilities, and avoiding conflict among visitor use activities.
36 CFR PART 3 -Boating and Water Use Activities
3.8(a)(1) Launching or operating an airboat is prohibited: The useof airboats is prohibited in the Barataria Preserve without prior authorization from the Superintendent. Justification: Closing Barataria waterways to airboat use by the public limits bank erosion, prevents damage to vegetation, wildlife habitat, and archaeological sites, disturbance to anglers, enhances the safety of park visitors in canoes or pirogues, and enhances visitor experience by providing an area free from mechanical noise.
36 CFR PART 4 -Vehicles and Traffic Safety
4.10(a) Operating a vehicle off road is prohibited: No vehicles shall operate off established public roadways without prior authorization from the Superintendent. Justification: Operating vehicles off road causes significant damage to park resources. ATV or UTV type vehicles are not street legal under Louisiana law and may not be operated anywhere in the park by the public. Employee use of ATV or UTVs is authorized only if the employee is on official business and has been properly trained.
36 CFR 4.21 Speed Limits
4.21(b) Speed Limits:
The following area is designated as five (5) miles per hour speed limit:
Barataria Preserve Visitor Center parking area
Bayou Coquille parking area
Pecan Grove parking area

The following roads are designated as fiftenn (15) miles per hour speed limit:

Justification: The listed speed limits have been established in order to protect the safety of park visitors, employees, resources, and facilities.
36 CFR 4.30 Bicycles
4.30(a) Use of bicycles is only permitted on park roads and in parking areas. Justification: The use of bicycles off road or on trails causes excessive damage to park resources and can threaten visitor safety. Commissioned park employees are authorized to use bicycles off road and on trails and must exercise due care while on patrol.
36 CFR 7.37 Jean Lafitte National Historical Park and Preserve
Jug line fishing: Fishing with an unattended baited line attached to a float (jug line fishing) is permitted within the Barataria Preserve with the following conditions:
The angler clearly marks the float with their name, phone number, and date last set.
Jug lines are checked at least once every 24 hours.
Jug lines are removed when no longer tended.
Trotlines and lines attached to anything other than a float are prohibited.
Justification: Jug line fishing is a traditional method of fishing used in the delta region and is permitted for that reason. The park has imposed regulations in order to mitigate the litter, fouling of motorboat propellers, and impact to the non-targeted species caused by unattended or abandoned jug floats.
Crawfish harvesting is permitted in the Barataria Preserve along roadside areas, and along the Wood Duck Trail, Lower Kenta Canal Area, and the Twin Canal trail, subject to the following harvesting conditions:
Crawfish harvesting occurs between March 1 and June 30.
Conducted up to 50 feet beyond the outside toe of the roadway, or trail shoulder, or embankment.
Conducted while using baited lift type mesh nets or baited wire traps. All other types of traps and methods, such as crawfish nets, dip nets, hand lines, or bait seines are prohibited.
Anglers are limited to ten (10) or fewer nets or traps. Each trap must be continuously attended.
Anglers require a valid State of Louisiana fishing license with a recreational crawfish trap gear license gear to harvest crawfish within the Barataria Preserve if using crawfish traps. (Crawfishing - Louisiana Fishing | eRegulations)

36 CFR 12.5 Interments
Eligibility for burial is determined in accordance with provisions of Federal statutory law. Interments are conducted in accordance with National Park Service and Veterans Administration policies.
12.10 - Floral and Commemorative Tributes
Fresh cut flowers, artificial flowers, wreaths, and small flags are permitted any time of year. Park staff will remove flags and floral items when they become faded or unsightly.
The following actions are prohibited:
Permanent below ground floral containers may not be used. Existing containers will not be maintained.
Attaching decorations or other objects to headstones or monuments is prohibited.
All other objects and decorations are prohibited and will be removed.
In accordance with the National Park Service Law Enforcement Reference Manual RM-9, the public is to be notified when parks monitor security cameras through CCTV. Jean Lafitte National Historical Park and Preserve and New Orleans Jazz National Historical Park uses CCTV for the purpose of monitoring secuity cameras to "help ensure public safety and security; facilitate the detection, investigation, prevention, and deterrence of terrorist attack and crime; help ensure the safety of citizens and officers; help assist in the proper allocation and deployment of law enforcement and public safety resources; help facilitate the protection of the innocent and the apprehension and presecution of criminals." (RM-9, Chapter 26, 4.1)
Futhermore, the NPS will operate CCTV cameras in a manner to facilitate legitimate law enforcement and public safety objectives. No person will be targeted or monitored merely because of race, religion, gender, sex, disability, national origin, and political affiliation views. (RM-9, Chapter 26, 4.2)
The following excerpt from RM-9, Chapter 26 orders that parks who have such programs allow for public notifications, specifically:
4.6 CCTV Public Notice and Comments
All parks using CCTV shal display a copy of the CCTV policy as part of their compendium and park website. The National Park Service encourages public comments regarding its CCTV policy and procedures contained in this policy, which we will periodically re-examine, and which is a matter of public record and discussion. Appropriate government officials and the Solicitor's Office must first review any suggested substantive revisions by the Park Service. Any public comments should be directed to the National Park Service's Associate Director of Visitor and Resource Protection.
