Special Conditions

NPS Liaison
The NPS liaison for the duration of the permitted activities shall be the Commercial Services Program Specialist, (540-999-3500 x3374). Only he/she or his/her supervisor may approve changes to the permit.

Changes in Permitted Activities
Refer to Form 10-114, SUMMARY OF PERMITTED ACTIVITY, and Provision 15.

  • The permittee shall not make changes to these specific permitted activities as summarized on the face of the properly executed Form 10-114 unless specifically approved by the NPS Liaison and/or his/her supervisor, well in advance.

  • For the purposes of this Permit, the definition of “advance” is well before the starting day/time of the permitted activity (minimum ten-business days) to allow sufficient time to review and approve the requested change, and adjust the Permit accordingly.

  • Upon commencement of the Permit begin-time, the NPS shall not approve changes to these specific permitted activities as summarized on the face of the properly executed Form 10-114, except for possible consideration due to weather related reasons.

Designated Person on Location Responsibilities
Should the Permittee designate a Person on Location responsible for adherence to all terms and conditions of this Permit, that that person’ immediate presence is required, and shall remain directly, and actively engaged with the activity and/or employees and/or associates for the entire time/length of the Permit. Should the Permittee not designate a Person on Location, the Permittee by default shall become the designated Person on Location.

  • The designated Person on Location shall act as the onsite point of contact for the NPS Liaison and/or his/her designated representative.

  • All communications between the NPS Liaison, the activity and/or employees, for the purposes of conducting the permitted activity shall go through the designated Person on Location.

  • Should the designated Person on Location break from direct and active engagement with the permitted activities for other than reasonable short periods (i.e. briefly attend to personal necessities), permitted activity shall halt until the designated Person on Location re-engages with the permitted activity.

  • Incapacitation of the designated Person on Location and/or the inability to perform, and/or carry out his/her responsibilities as outlined in this Permit, shall cause a halt to permitted activities, and the Permit shall terminate.

Monitoring
The NPS shall not monitor this Permit.

Vehicles
All vehicles shall park correctly in legal parking spaces on a first-come, first served basis (no reservation of parking spaces).

  • Do not park on roads, road shoulders, or block any access.

  • Vehicles shall not impede road traffic or visitor access in any way.

  • Commercial transportation is not authorized within the boundaries of the park, unless specifically approved, in advance.

  • Vehicles shall not travel off-road.

Entry Fees
Entry fees do not apply, specifically for conducting the activities authorized under this permit. However, the Permittee and/or employees/associates, and/or participants shall show a copy of this permit to entrance station staff upon entry into the park, to enter without charge. Should the Permittee and/or employees/associates, and/or participants engage in recreational activities outside the activities authorized under this permit, entry fees apply, specific to the type of entry into the park.

Off-Trail Prohibited
The Permittee and/or employees/associates, and/or participants, and/or guests is/are expressly prohibited from entering any closed/out-of-bounds areas or from leaving established trails, walkways and visitor areas. Vehicle or foot travel off designated roadways, walkways, sidewalks, or trails is not permitted.

Banners, Memorials, Photos, Plaques, Signs, etc.
Shenandoah National Park specifically prohibits placement of the following:

  • Banners

  • Memorials, photos, and/or plaques

  • Signs

Authorized Use of Area
This permit authorizes the Permittee use of Indicate approved area for the purposes of conducting the First Amendment Activity.

  • This permit does not reserve the location nor grant the Permittee exclusive use rights of the area.

  • The area shall remain open to all visitors for the duration of this permit.

  • The Permittee employees/associates, and/or participants shall not interfere with Park visitors, or normal visitor activity.

  • All activities conducted under the authority of this Permit shall be in accordance with 36 CFR 2.51 and other applicable laws and regulations.

Printed Materials
This permit authorizes the Permittee to distribute printed materials

Authorized Equipment
Authorized equipment is limited to 2 (two) small portable carts to display literature available to interested visitors.

Electrical Power
Electrical power is not furnished. The Permittee shall not connect to any power sources located anywhere within park boundaries. Generators are not authorized.

Audio Devices
Audio devices (e.g. electrified musical instruments, P.A. systems, tape players, etc.) are prohibited. The use of amplifiers or other noise producing mechanisms requires the advance approval of the Superintendent and the issuance of a separate permit.

Use of Native Materials
Native materials shall not be disturbed and/or used for props except, as a natural backdrop. Off-trail is not permitted.

Attachments and Coverings
Permittee employees/associates, and/or participants, and/or guests under this Permit shall not attach anything to any NPS facility, structure, rock, ground, or vegetation. Permittee and/or participants under this Permit shall not erect any cover, nor cover or remove signs, fences, or posts, natural features, etc.

Ground Disturbing Activities
The Permittee employees/associates, and/or participants, and/or guests under this Permit shall not engage in any ground disturbing activities, whatsoever.

Disturbance of Natural Features and/or Wildlife
Permittee employees/associates, and/or participants, and/or guests under this Permit shall not dig, scrape, remove, or otherwise disturb any natural features, nor disturb any wildlife.

Compliance
The Permittee and/or employees/associates, and/or participants, and/or guests under this Permit shall comply with all legal instructions of authorized Park officials at the activity site.

Waste Disposal (Pack-in, Pack-out)
The Permittee and/or employees/associates, and/or participants, and/or guests under this Permit shall follow a leave-no-trace policy and restore the area of use to the same condition prior to use, or better. The Permittee and/or employees/associates, and/or participants, and/or guests under this Permit shall dispose of all such waste and debris associated with activities authorized within this Permit outside the park boundaries. The Permittee and/or participants under this Permit shall not use garbage collection facilities provided for the public within the park, for the disposal of refuse associated with this Permit.
